In Mexico there is a common practice that generates property problems: paying for a property, moving in and even living in it for years without the transaction being formalized before a notary public.


This also frequently occurs in pre-sale developments, where the buyer signs a contract, pays installments, and later the developer asks them to formalize the transaction through the deed.


It may seem like a minor formality, especially when payment, delivery, or a promise of delivery has already been made. But legally speaking, someone without a deed cannot prove ownership. And that has real consequences, particularly when property registration is not completed in Yucatán.



What is a property deed registration (escrituración) and why does it matter?

A public deed is a document prepared and signed before a notary that formalizes the transfer of ownership of a property. Once the deed exists and is registered in the Public Registry of Property, the new owner has a right enforceable against third parties.


Without a deed, the right exists between the parties to the contract, but it is not protected against others. This is especially relevant in pre-sale transactions: until the property deed is formalized in Yucatán, the buyer does not fully consolidate their right against third parties.
